ANNA MERRILL (CAPTAIN BENJAMIN MERRILL and JEMIMA SMITH) was born 1754 in Rowan County , North Carolina, and died Bef. 07 Mar 1828 in Howard County, Missouri.  She married BOYD MCCRARY Bef. 09 May 1777 in Rowan County , North Carolina.  He was born 1754 in Rowan County, North Carolina, and died 14 Oct 1819 in Buncombe, North Carolina.

NANCY ANNA MERRILL

 

Nancy Anna Merrill's parents Capt. Benjamin and Jemima Smith Merrill moved from New Jersey to Rowan County , North Carolina just before she was born. Nancy (Merrill) McCrary died prior to March 7, 1828 in Howard County, Missouri, for on that date her son Benjamin McCrary was appointed as administrator of her estate, with Elijah McCrary and William Cornett serving as his securities.  A certified copy of Boyd McCrary's will and probate was prepared by the Buncombe County, North Carolina Clerk of Court on November 8, 1832, and recorded in Howard County, Missouri on July 13, 1833, many years after his death, as a result of a court case between James McCrary and Benjamin McCrary concerning a slave issue.

Notes for BOYD MCCRARY:

 

Boyd McCrary was born about 1750-1755 probably in Rowan (now Davidson) County, North Carolina, the son of Hugh McCrary and Susannah Whitaker.  Prior to May 9, 1777, he married Anna Nancy MERRILL, daughter of Captain BENJAMIN MERRILL and wife Jemima Smith.  On February 5, 1778, he was appointed guardianof his brothr-in-law JONATHAN MERRILL.  In his father's will dated February 14, 1785 he received 249 acres of land on which he was then living.  He was also appointed executor of the will, along with his brother John McCrary.  About 1798 McCrary and his wife, along with brother-in-law BENJAMIN MERRILL and his wife Penelope, migrated from Rowan County, North Carolina to Buncombe County, North Carolina, settling on Cane Creek in the vicinity of present day Fairview, North Carolina.  On September 17, 1799, Boyd McCrary obtained 320 acres from William Wilson on Cane Creek in Buncombe County, North Carolina (Buncombe Co. Deed Book 5, p. 43).  McCrary was evidently still holding lands in Rowan County after his migration, for on February 12, 1800, he acquired 59 acres on Swearing Creek from John McCrary (Rowan Co. Deed Book 17, p 378).  He resold the land on February 13, 1800 to Jacob Wagoner of Rowan County (Rowan Co. Deed Book 18, p. 246).  On January 14, 1805, the heirs of Hugh and Susannah McCrary brought a suit against Boyd and John McCrary, executors of the estate.  The case contains several answers filed by Boyd McCrary during the August Term of Court in 1805.

 

Boyd McCrary devised his will in Buncombe County, North Carolina on October 18, 1815, appointing his wife Nancy and his son James McCrary as his executors.  The will was witnessed by John Whitaker, ANDREW MERRILL, BENJAMIN MERRILL, and Joseph Henry.  In September, 1818, he conveyed 170 acres in Buncombe County, North Carolina to his son James McCrary, the tract being a part of the land originally purchased in 1799, (Buncombe County Deed Book 12, p. 144).  Boyd McCrary apparently died prior to March 32, 1819 in Buncombe County, North Carolina, for on that date his will was probated.  Boyd McCrary may possibly be buried in an unmarked grave in Cane Creek Cemetery, Fairview, North Carolina.  Following Boyd's death, his widow Nancy along with various children migrated to Howard and Davies County, Missouri.  This may have occurred about 1823, for on August 12, 1823, Benjamin and Elijah McCrary of Howard County, Missouri sold land in Buncombe County to James and John McCrary (Buncombe Co., Deed Book 6, p. 24).
