BENJAMIN SMITH MERRELL (JOHN, CAPTAIN BENJAMIN MERRILL and JEMIMA SMITH) was born 18 Apr 1792 in Sparta, Hancock County, Georgia, and died 29 Sep 1853 in Carroll County, Georgia.  He married MARTHA PATSEY CHANDLER 28 Feb 1813 in Franklin, Georgia, daughter of JOSEPH CHANDLER and SARAH FARMER.  She was born 04 Sep 1795 in Granville, North Carolina, and died 11 Sep 1879 in Carroll County, Georgia.

Benjamin Smith Merrell served an apprenticeship under his brother-in-law, Enos Mershon, at Sparta, Georgia, in the saddle tree business, which was then a good trade. He went from Sparta to Washington, Wilkes County, Georgia. and worked there until he arrived at manhood, when he moved to Franklin County Georgia, and then in his twenty-first year married Patsy Chandler, the eldest daughter of Joseph and Sarah Chandler, who were respectable and well-to-do farmers. Benjamin and Patsy remained there from that time, 1813, working at his said trade and running a little farm, and filling the Office of Justice of the Peace for 12 years, until 1832, when they moved with his family to the then wilds of Carroll County, Georgia. He had not been there long until he was elected Justice of the Peace again which office he held most of the time until his death September 25, 1853. The 1840 Federal census for the 714th District, Carroll County, Georgia, lists Benjamin S. Merrell, with one male under five, one male 5 to10, one male 10 to 15, one male 40 to 50, one female 5 to 10, two females 10 to 15, and one female 40 to 50.

 

The 1830 Federal census for the Roll 235, Franklin County, Georgia, lists Benjamin S. Merrell, with one male under 5, three males 10 to 15, one male 30 to 40, one female under 5, one female 5 to 10, one female 15 to 20, and one female 30 to 40.

 

Benjamin S. was commissioned Justice of the Peace of Franklin County, Georgia on July 12, 1822 (History of Franklin County). He served on the Grand Jury of Franklin County for April, 1826, that recommended an additional tax of fifty percent of the State Tax for the purpose of defraying the expense of building a new courthouse, which was later enacted November 30, 1826 by the State government. Benjamin drew Lot 77 in District 16, Section 2, in the 1832 Gold Lottery of Georgia (Southern Historical Press). Benj. Merrell was granted 40 acres in 1802 located in Screven County, Georgia, as listed in Georgia Grant Book DDDDD page 648.Screven County is located adjacent to the Savannah River about halfway between Augusta and Savannah, Georgia. Benjamin S. Merrell was a fortunate drawer in the 1832 Gold Lottery of Georgia for Franklin County, Willis Militia District, lot 77, District 16, Section 2. Benjamin Merrell was a fortunate drawer in the Cherokee Land Lottery, Seventh District, Third Section, for No. 124 in Carroll County, Georgia.
